This privacy policy (“Privacy Policy”) describes Foremost Groups, Ltd.’s (hereafter referred to as “Foremost,” “we,” “us,” or “our”) policy regarding information collected from and about you in connection with your visits to our website (the “Web site”) and interactions with other Foremost applications, communications, and online services that link to this Privacy Policy (collectively with the Web site, the “Online Services”). This Privacy Policy informs you about the information we collect, how we use and share it, and your rights with respect to your information.  The amount and type of information received by Foremost depends on how you use our Online Services.

IF YOU ARE A CALIFORNIA RESIDENT, this Privacy Policy also informs you about the personal information we collect from and about you in other contexts, including personal information collected online or offline in connection with our products and services and your interactions with Foremost employees.  California residents can learn more about the personal information we collect from and about you, including how we may use and share it, as well as your rights under California law, in the Privacy Policy’s Supplemental Notice for California Residents below (which is incorporated in and a part of this Privacy Policy).

NORMAL WEB SITE USAGE:

During normal Web site usage, except for certain data about how you and other visitors interact with our Online Services (as described under Information Collected Automatically below), you can visit Foremost’s Web site and other Online Services to read product information without telling us who you are and without revealing any personal information.  During normal Web site usage, we do not collect or store personal information such as your name, mailing address, e-mail address, phone number, or Social Security Number.

COLLECTION OF PERSONALLY IDENTIFIABLE INFORMATION:

There are instances where Foremost requests personally identifiable information to provide a service (e.g., warranty registration) or correspondence, including promotional activities, responding to inquiries, providing details about new products, and sharing news. This information, such as your name, mailing address, e-mail address, type of request and possibly additional information, is collected and stored in a manner appropriate to the nature of the data and is used to fulfill such activities. The information you provide is also used by Foremost to improve the services we provide you. We also collect information about the products you have purchased for warranty purposes. The information described in the section is never provided to or sold to any other company. When possible, Foremost will provide you with the means to make sure that any personally identifiable information that you provide is correct and current.

ELECTRONIC MAIL SENT TO US THAT CONTAINS PERSONAL INFORMATION:

You may also decide to send Foremost personally identifying information, for example, in an electronic mail. Foremost will only use this information to identify the user and respond to the inquiry. We will not use this information other than to resolve the matter identified in your message.

INFORMATION COLLECTED AUTOMATICALLY:

When you visit or interact with our Online Services, our servers record certain information that is automatically reported by your browser, such as IP address (which can be used to infer approximate location), internet service provider, browser type and settings, device information (e.g., type of device, operating system, device manufacturer), referring/exiting URL (the website or online ad that referred you to us and the website you go to after leaving our Web site), request/response date and time, clickstream data, device or advertising ID, and information contained in cookie files that are sent to and stored by your browser.  Depending on the Online Service and your device permissions, we may also passively (that is, gathered without you actively providing the information) collect information about your device’s approximate (e.g., country or zip code) or precise location. Various technologies may be used to collect this location information, such as IP address, GPS, and other sensors that may provide information on nearby devices, Wi-Fi access points, and cell towers.  Some of the information we collect depends on the settings on your web browser or mobile device. Like most website operators, our Web site and other Online Services use cookies and similar technologies—such as pixel tags, local storage, statistical identifiers, and software development kits (collectively referred to as “cookies and similar technologies”)—to collect, track, and store the information collected passively through your use of our Online Services.  A cookie is a small text file that a website saves on your browser when you visit the site, either for the duration of your visit (a session cookie) or for repeat visits (a persistent cookie).  Session cookies are deleted from your computer or device once you leave the website.  Persistent cookies remain on your device and are sent back to the originating website on subsequent visits (or to another website that recognizes the cookie) to notify the website of your previous online activity.  Cookies on Web site may be delivered by Foremost (a first-party cookie) or a third-party (a third-party cookie) and may also be set in association with emails you receive from us.  Cookies help us enhance your experience when using our Online Services.  They also help us understand how people use our Online Services (such as which pages or features are most popular) so that we can better serve our visitors.

In addition to cookies, we may use other similar technologies with our Online Services, such as pixel tags (also known as clear GIFs, web beacons, pixels, or web bugs), local storage, statistical identifiers, and software development kits.  Pixel tags are small blocks of code installed on a website that allow a third party to deliver its third-party cookies when a visitor goes to the website and are generally used by third parties to monitor and track user activity on a website.  Local storage (such as HTML 5) allows a website to store and retrieve data on an individual’s device with no expiration date.  Statistical identifiers refer to identifiers created using certain device and server data.  Collectively, this information makes a user’s browser or device sufficiently distinct for a website to reasonably determine that it is encountering the same browser or device over time and used for the same purposes as cookies.  Software development kits (also called SDKs) function like third-party cookies and pixel tags but operate in the mobile app environment where cookies and pixel tags do not function as effectively.  Instead of using cookies and pixels tags, an app developer can install pieces of code provided by third parties (such as analytics providers) in its mobile app in order for the third parties to monitor and analyze the use and performance of the mobile app.

Cookies and similar technologies enable us and our partners to recognize when someone has visited our Online Services or opened an email, allowing us to do things such as monitor the traffic patterns of users from one page within our Web site to another, understand whether a visitor has come to our Web site from an online advertisement displayed on a third-party site or in an email, and measure and improve the performance of our Online Services.  These technologies are also used to help secure our Online Services and for other legitimate purposes (as described in the table below).  The following table sets out the different types of cookies and similar technologies that our Web site and other Online Services may use and why we use them:

DISCLOSURES:

Supplemental Notice for California Residents[Last Updated January 16, 2020]
Why? This Supplemental Notice for California Consumers (“Supplemental Notice”) is part of the Privacy Policy and supplements the information contained in the Privacy Policy. This Supplemental Notice applies solely to individuals who are residents of the State of California.

Your Rights If you are a California resident, you have the following rights under the CCPA with respect to your personal information:

Foremost does not sell personal information and Foremost does not sell the personal information of minors under 16 years of age without affirmative authorization.

·        Right Not to Be Subject to Discrimination.  You have the right to be free from discrimination or retaliation for exercising any of your rights under the CCPA as described above.

We value the security and confidentiality of your personal information. Along with your request, we ask that you provide you first and last name, company name (if applicable), physical postal address, email address, and IP address (if you interact with our websites or other online services).
